1. Acceptance of Terms

By accessing and using ConserNews ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

ConserNews is a news aggregation and personalization platform that provides users with curated news content from various sources. Our service includes:

  • Personalized news feeds based on user preferences
  • News content from multiple trusted sources
  • User account management and customization options
  • Links for sharing and opening stories at their original source
  • Mobile and web-based access to content

3. User Accounts

To use the personal briefing and read articles, you must create an account and hold an active membership. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your password and account
  • Promptly update account information to keep it accurate
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized account use

4. Acceptable Use

You agree to use ConserNews only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the service for any unlawful purpose or to solicit unlawful acts
  • Violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
  • Infringe upon or violate our intellectual property rights or the intellectual property rights of others
  • Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
  • Submit false or misleading information
  • Attempt to gain unauthorized access to our systems
  • Use automated scripts to collect information or interact with the service

5. Content and Intellectual Property

The ConserNews interface, branding, and original software are protected by applicable intellectual-property laws. Aggregated headlines, summaries, images, and linked articles remain subject to the rights of their original publishers.

  • Our Content: We grant you a limited, non-exclusive, non-transferable license to access and use our content for personal, non-commercial purposes.
  • Third-Party Content: News articles and content from third-party sources remain the property of their respective owners.
  • Your account choices: Saved favorites and preferences are used only to provide the features you request.

6. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our service, you consent to the collection and use of information as outlined in our Privacy Policy.

7. Subscription and Payment Terms

ConserNews may offer both free and premium subscription services:

  • Free Preview: Cards for the latest six stories; opening articles requires a membership
  • Premium Service: Unlimited access, personalized feeds, and favorites sync
  • Payment: Web subscriptions cost USD $4.99 monthly or USD $49.99 yearly, billed in advance. Mobile stores display the applicable local price before you confirm.
  • Automatic Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • Cancellation: You may cancel at any time, in the place you subscribed — see below

Who sells you the subscription depends on where you buy it, and this changes who holds your money and who can refund it:

  • On consernews.com, we sell the subscription and take payment through ArlaPay, our payment provider. Cancel in the ArlaPay billing portal linked from your receipt.
  • In the iOS app, Apple is the seller. Your purchase is also governed by Apple's Media Services terms, payment is charged to your Apple Account, and you cancel in your iOS Subscriptions settings.
  • In the Android app, Google is the seller. Your purchase is also governed by the Google Play terms, payment is charged to your Google Play account, and you cancel in Play Store Subscriptions.

A website subscription restores through your ConserNews account or ArlaPay subscription code. An app subscription follows the Apple Account or Google account that bought it; signing in to ConserNews can also mirror that app purchase to the website. A purchase is managed, cancelled and refunded only where it was bought. Refunds are governed by our Refund Policy, and app purchases by the policy of the store that sold them.

8. Disclaimers and Limitation of Liability

ConserNews is provided "as is" without any representations or warranties, express or implied. We make no representations or warranties in relation to this website or the information and materials provided.

  • We do not warrant that the service will be uninterrupted or error-free
  • We are not responsible for the accuracy or reliability of third-party content
  • Our liability for any damages arising from your use of the service is limited to the amount you paid for the service
  • We are not liable for any indirect, incidental, special, or consequential damages

9. Indemnification

You agree to indemnify and hold harmless ConserNews, its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of and access to the service.

10. Termination

We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the service will cease immediately.

11. Changes to Terms

We may update these Terms as the service changes. The revision date identifies the current version, and we will provide notice of material changes when applicable law requires it.

12. Governing Law

These Terms shall be interpreted and governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the jurisdiction of the courts of the Commonwealth of Pennsylvania, unless the consumer-protection law where you live gives you the right to bring proceedings there instead.
